5. Legal bases for processing

Under the GDPR and UK GDPR, we must have a legal basis for processing your personal data. The legal bases we rely on are:

  • Consent (Art. 6(1)(a)): You have given us clear consent to process your personal data for a specific purpose, such as sending marketing emails or placing non-essential cookies. You can withdraw consent at any time.

6. Payment processing and transaction data

We use authorized payment processors and regulated banking partners to accept payments for our services. Payment processors act as independent data controllers for the personal data they collect from you during checkout. We act as a data controller solely for the limited transaction metadata we receive from them.

// important — what we do NOT store
→ Full credit/debit card numbers
→ Card verification values (CVV/CVC)
→ Bank account credentials or passwords

All sensitive payment data is handled directly by certified payment processors. It never touches our servers.

6.1 Card payments

When you pay by card, payment is processed on PCI-DSS Level 1 compliant infrastructure. We receive the following transaction metadata:

  • Transaction ID and gateway charge reference
  • Last 4 digits of the card used
  • Card brand (Visa, Mastercard, Amex, etc.)
  • Payment status (succeeded, failed, refunded, disputed)
  • Billing name and billing address
  • Amount, currency, and timestamp of the transaction

6.2 Bank transfers

When you pay via domestic or international bank transfer, we receive the following confirmation metadata:

  • Bank transfer transaction reference number
  • Payer name and originating account identifier (as provided by banking rails)
  • Payment status and clearing date
  • Amount, currency, and timestamp

6.3 Refunds, chargebacks, and disputes

If you request a refund, initiate a chargeback, or dispute a payment, we will process the relevant transaction data with the payment processor to resolve the matter. This may include sharing your name, email, transaction details, and correspondence related to the dispute with the processor and, if necessary, with the card-issuing bank or dispute resolution network.

6.4 PCI DSS compliance

We do not collect, store, or transmit cardholder data. All card data is tokenised and processed directly by our authorized payment gateway through their hosted payment pages or embedded iframe fields. We do not fall within the scope of PCI DSS self-assessment because we never handle raw card data.

7. Sub-processors and third-party services

We use the following third-party services to operate our business. Each acts as a data processor on our behalf (unless noted otherwise as an independent data controller). We have data processing agreements (DPAs) in place with all processors where required by Article 28 of the GDPR.

8. International data transfers

Some of our sub-processors and payment processors process personal data outside the United Kingdom and the European Economic Area (EEA). When this happens, we ensure that appropriate safeguards are in place to protect your data in accordance with Chapter V of the GDPR and UK GDPR.

8.1 Safeguards used

  • UK International Data Transfer Agreement (IDTA): For transfers from the UK to third countries, we rely on the IDTA issued by the UK Government under Section 119A of the Data Protection Act 2018.
  • EU Standard Contractual Clauses (SCCs): For transfers from the EEA to third countries, we rely on the European Commission's Standard Contractual Clauses (2021/914).
  • UK Addendum to EU SCCs: Where both UK and EU transfers are involved, we use the UK Addendum alongside the EU SCCs.
  • Adequacy decisions: Where the receiving country has been deemed adequate by the UK Government or European Commission (e.g., EU member states, Switzerland, Japan), no additional safeguards are required.
  • Binding Corporate Rules (BCRs): Some of our processors (e.g., Google) have approved BCRs that provide an alternative transfer mechanism.

8.2 Transfer Impact Assessments (TIAs)

For transfers to countries without an adequacy decision (particularly the United States), we conduct Transfer Impact Assessments in accordance with the Schrems II ruling (CJEU Case C-311/18). These assessments evaluate whether the laws of the receiving country could undermine the safeguards provided by the SCCs or IDTA, and whether supplementary measures are needed.

8.3 Payment processor transfer safeguards

  • Payment gateway and banking partners maintain certifications under the EU-US Data Privacy Framework (DPF), UK Extension, and standard contractual clauses (SCCs) to ensure equivalent protection for international transaction routing.

9. Data retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying legal, accounting, or reporting requirements. After this period, data is deleted or irreversibly anonymised.

When the retention period expires, we either permanently delete the data or anonymise it so that it can no longer be linked to you. Anonymised data may be retained indefinitely for statistical and research purposes, as it is no longer personal data under the GDPR.

10. Security measures

We implement appropriate technical and organisational security measures to protect your personal data against unauthorised access, loss, destruction, or alteration. These measures are reviewed regularly and adjusted in response to emerging threats.

10.1 Technical measures

  • Encryption in transit: All data transmitted between your browser and our servers is encrypted using TLS 1.2+ (HTTPS). All API calls to payment gateways use encrypted TLS endpoints.
  • Encryption at rest: All stored personal data on our infrastructure (Vercel, Google Workspace, Notion) is encrypted at rest using AES-256 or equivalent.
  • Tokenisation: Payment data is tokenised by authorized payment gateways. We never store raw card data, CVV, or bank credentials.
  • Access controls: Role-based access control (RBAC) with least-privilege principle. Only authorised personnel can access personal data, and only for specific tasks.
  • Multi-factor authentication (MFA): All internal systems, admin panels, and cloud infrastructure require MFA for all users.
  • Network security: Cloudflare WAF, DDoS protection, and rate limiting are active on all endpoints. Server infrastructure is isolated and firewalled.
  • Secure development: Dependencies are scanned for vulnerabilities. Code changes are reviewed before deployment. No secrets or API keys are committed to repositories.
  • Backup and recovery: Critical data is backed up with encrypted backups. Recovery procedures are tested periodically.

10.2 Organisational measures

  • Staff training: All team members receive data protection training on appointment and annually thereafter, covering GDPR, UK GDPR, and this Privacy Policy.
  • Confidentiality agreements: All personnel are bound by confidentiality obligations that survive termination of their engagement.
  • Data minimisation: We collect only the personal data necessary for each specific purpose. Project data is scoped to what is needed for the engagement.
  • Incident response plan: We maintain a documented incident response procedure. In the event of a personal data breach, we will notify the relevant supervisory authority within 72 hours, as required by Article 33 of the GDPR, and affected individuals without undue delay where there is a high risk to their rights and freedoms (Article 34).
  • Vendor due diligence: We assess the security and compliance posture of all sub-processors before engaging them and review them periodically.
  • NDA before codebase access: We sign mutual NDAs before accessing any client codebase or sensitive system. All client data is treated as confidential by default.
